Terms of Use
1. About Rooky
Rooky is a scorecard application operated by TinkerMedia LLC ("TinkerMedia," "we," "us," or "our"). The App allows users to create, customize, save, and use scorecards while playing games.
Rooky is designed as a general-purpose scorekeeping tool and does not provide the games themselves unless expressly stated within the App.
2. Acceptance of These Terms
By downloading, installing, accessing, or using Rooky, you agree to these Terms and any applicable laws and regulations. If you do not agree to these Terms, you should not use Rooky.
3. Eligibility
Rooky is intended for a general audience. You may use Rooky if you are legally permitted to do so under the laws applicable to you. If you are under the age of majority in your jurisdiction, you should use Rooky with the involvement of a parent or legal guardian where required by applicable law.
4. No Account Required
Rooky does not require users to create an account or provide personal information in order to use the App.
5. Local Storage
Rooky allows you to create, customize, and save scorecards locally on your device. Your scorecards are not stored on a TinkerMedia server or synchronized to an online account.
Because scorecards are stored locally, TinkerMedia cannot recover them if they are deleted, lost, corrupted, or become inaccessible because of a device failure, operating-system change, App removal, or other event outside TinkerMedia's control. You are responsible for maintaining any backups of information you wish to preserve.
6. Your Use of Rooky
You may use Rooky for lawful personal purposes, including creating and using scorecards while playing games.
You agree not to:
- Use Rooky for unlawful, fraudulent, or malicious purposes;
- Attempt to interfere with or compromise the security or operation of Rooky;
- Reverse engineer, decompile, or disassemble Rooky except to the extent that applicable law expressly permits such activity;
- Modify, redistribute, sublicense, sell, or commercially exploit Rooky or its components without TinkerMedia's written permission; or
- Use Rooky in a manner that violates applicable law or these Terms.
7. Your Scorecards and Content
You retain ownership of scorecards and other content that you create using Rooky. TinkerMedia does not claim ownership of your game information or scorecard content.
Because your scorecards are stored locally on your device and are not transmitted to TinkerMedia, TinkerMedia does not review, monitor, or moderate the contents of your locally stored scorecards.
8. Intellectual Property
Rooky, including its software, user interface, visual design, branding, logos, original text, graphics, and other materials supplied by TinkerMedia, is owned by or licensed to TinkerMedia LLC and is protected by applicable intellectual-property laws.
Subject to these Terms, TinkerMedia grants you a limited, non-exclusive, non-transferable, revocable license to install and use Rooky on devices that you own or control for lawful purposes.
9. No Fees, Subscriptions, or In-App Purchases
As of the effective date of these Terms, Rooky does not offer subscriptions, in-app purchases, or paid features within the App.
TinkerMedia may change Rooky's business model or introduce paid features in a future version. If that occurs, applicable pricing and purchase terms will be presented before a purchase is made and these Terms may be updated accordingly.
10. Availability and Updates
We may update, modify, suspend, or discontinue Rooky or any of its features at any time. Updates may be necessary to maintain compatibility, security, performance, or functionality.
We do not guarantee that Rooky will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.
11. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Rooky is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited.
12. Limitation of Liability
To the maximum extent permitted by applicable law, TinkerMedia LLC and its owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of Rooky.
To the maximum extent permitted by applicable law, TinkerMedia's total liability for claims arising from or related to Rooky or these Terms will not exceed USD $100.
Nothing in these Terms limits liability that cannot lawfully be limited under applicable law.
13. Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless TinkerMedia LLC and its owners, officers, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, and expenses arising from your unlawful use of Rooky or your violation of these Terms.
14. Termination
You may stop using Rooky at any time by uninstalling the App from your device.
TinkerMedia may discontinue Rooky or restrict access to the App if reasonably necessary for legal, security, technical, or business reasons.
15. Privacy
Rooky's privacy practices are described in the Privacy Policy. Rooky does not collect or transmit personal information or user-created scorecards.
16. Third-Party Platforms
Rooky may be distributed through third-party app stores, including Google Play and the Apple App Store. Your use of those platforms is subject to their respective terms, policies, and rules.
These Terms govern your use of Rooky itself and do not replace the terms applicable to the platform from which you downloaded the App.
17. Changes to These Terms
We may update these Terms when Rooky changes, when we introduce new features or services, or when required by law. We will update the effective date when the Terms are revised. Your continued use of Rooky after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
18. Governing Law
These Terms are governed by the laws applicable to TinkerMedia LLC and the jurisdiction in which TinkerMedia LLC is organized, without regard to conflict-of-law principles, except where applicable law requires otherwise.
